FLSA Exemption Changes – Where Are We Now?

In May 2016, President Obama announced a final rule amending the regulations related to the Fair Labor Standards Act (FLSA). The changes concerned certain exemptions from the overtime requirements under the regulations. A lot has happened since May 2016. The final rule was targeted to be effective on December 1, 2016. However, before it could take effect, in November 2016, a federal court in Texas issued a nationwide injunction that delayed the implementation of the new rule. Further, the Department of Labor just announced recently that it will be seeking public input on the existing rules. This public input may result in an entirely new set of proposed rules by the Department. This presentation will address these recent developments and provide insight on how employers should be responding to these developments.
