Implementing the Revised Fair Labor Standards Act Rules

On April 23, 2024, the U.S. Department of Labor issued final regulations updating the minimum threshold for employees to be considered exempt form overtime requirements under the Fair Labor Standards Act. The regulations increase the minimum salary from the current level of $684 per week (about $35,568 per year) to $844 per week ($43,888 per year), effective July 1, 2024, and $1,128 per week (about $58,656 per year), effective January 1, 2025. Under the new rules, teachers will still not be subject to the salary basis or salary level requirement. In addition, under the new rules, educational administrators still may be paid a different minimum salary amount. It is likely that opponents will sue to block the new rules. However, for the time being, school district officials need to start planning changes to comply with the new rules effective July 1, 2024. This presentation will provide an overview of the law and an update on many of the changes to ensure that your district stays legally compliant with the FLSA and wage and hour laws.
